Overview

This course will cover the 10 most common mistakes employers make with regard to the Family and Medical Leave Act (FMLA) and the Americans with Disabilities Act (actually the ADA, Americans with Disabilities Act Amendments Act, referred to as ADA for ease) and how to avoid them.

  • Who the courts say is included in the definition of the word employer and failing to recognize this includes you
  • Failing to recognize that your organization is an FMLA-qualified employer and what that means to you
  • Failing to recognize what the courts consider a request for an accommodation under the ADA (hint, a formal request is not required)
  • Not recognizing the revelation of an FMLA serious medical condition by an employee and failing to fulfill your legal obligations
  • Not understanding the ADA 4-step interactive process and failing to initiate it when required
  • Behaving in ways (whether intentional or not) that create what the courts consider a hostile work environment related to the ADA or that constitute FMLA interference
  • Behaving in ways (whether intentional or not) that create what the courts consider retaliation, with regard to the ADA or FMLA
  • Failing to take the proper procedural steps in making a formal decision regarding what is and is not an undue hardship related to the ADA
  • Improperly denying FMLA leave (including showing a lack of understanding of which family members are covered) or not taking the legally required steps when other decision-makers improperly deny FMLA leave (being scared is not good enough) 
  • Failure to ensure U.S. Supreme Court required ADA leave is administered in addition to required FMLA Leave
